Director of Trial Services at Clarity Partners, Laura Zehner, will speak at the 2016 Claims and Litigation Management Alliance (CLM) Midwest Conference held June 23, 2016 at the Hilton Omaha, along with other noted legal professionals. Ms. Zehner’s session is entitled “The Pros and Cons of an Affordable Care Act (ACA) Defense: Jurors’ Views and an Insured’s Perspective.”
The presentation will explore whether jurors accept arguments regarding the ACA and if the arguments make sense from an insured’s perspective to pay for the discovery and experts associated with the ACA. The presentation will briefly examine the state of the law surrounding the ACA, the differences in life care plans with and without the ACA, and jurors’ comments and reactions to the ACA using clips from mock trials and focus groups. In addition, a claims industry representative from a national insurance carrier will give her perspective on when it makes sense to pay for the costs associated with an ACA defense.
